| (a) DADS contracts with a person to be a CDSA in accordance with Chapter 49 of this title (relating to Contracting for Community Care Services). A CDSA provides FMS and, when requested by an individual or LAR participating in the CDS option, support consultation services. (b) Before contracting with DADS as a CDSA, an applicant must: (1) have at least one person employed by the CDSA attend and complete required CDSA training provided or authorized by DADS; and (2) have at least one eligible employee or contractor to provide support consultation services as defined in Subchapter F of this chapter (relating to Support Consultation Services and Support Advisor Responsibilities). (c) A contracted CDSA must not provide FMS and case management services to the same individual. A provider of one service must not be a related party for common ownership or control of the provider of the other service. DADS evaluates common ownership and control using 1 TAC §355.102(i). |
