| (a) Scientific reclassification or change in nomenclature of taxa at any level in taxonomic hierarchy will not, in and of itself, result in redefinition of a harmful or potentially harmful exotic species. (b) Except as provided in §57.113 of this title (relating to Exceptions), it is an offense for any person to release into the water of this state, import, sell, purchase, transport, propagate, or possess any species, hybrid of a species, subspecies, eggs, seeds, or any part of any species defined as a harmful or potentially harmful exotic fish, shellfish, or aquatic plant. (c) Except as specifically authorized in writing by the department, it is an offense for anyone to remove a live grass carp from the water of this state where grass carp have been introduced under a permit issued by the department. (d) Violation of any provision of a permit issued under these rules is a violation of these rules. |
