RULE §21.260Limitations

(a) The total amount of repayment assistance to a physician may not exceed $160,000 over a period of no more than four periods of service.

(b) Except under circumstances determined by the Board and DSHS to constitute good cause, failure to meet the program requirements will result in non-payment for that service period and removal from the program. Additionally, providers who do not meet the requirements will be ineligible to apply for other loan repayment programs in Texas. Physicians practicing in HPSAs will be released from the agreement to provide four years of eligible service for any year for which loan repayment funds are not available.

(c) A physician may not receive loan repayment assistance under both Texas Education Code, §61.531 and Texas Government Code, §510.156 relating to funds appropriated for purposes of correctional managed health care.

(d) Physicians who are not practicing in HPSAs must apply for participation in the program each year by established deadlines and will be subject to the ranking criteria set forth in §21.257 of this title (relating to Application Ranking Criteria).

(e) Applications from physicians who establish eligibility under §21.257(4) of this title will be considered only if funds are available after financial commitments for the fiscal year have been made to physicians practicing in HPSAs and secure correctional facilities.
