RULE §376.519What procedures must a contractor follow when authorizing or denying an applicant benefits?

Contractors must follow procedures established by federal regulations under 45 CFR §400.54 as applicable for a public/private administered program when authorizing or denying services. This includes giving the participant a written notice that clearly states:

  (1) the action;

  (2) the reason(s) for the action; and

  (3) the right to a hearing in the case of denial.
